1. Who we are and scope
FondMelody is the brand and service responsible for deciding how personal information is used in connection with the FondMelody website, custom-song questionnaire, checkout, private order portal, song production and customer support. In data-protection language, the business operating FondMelody is the controller or business for this processing.
This Policy applies when you browse the site, submit part or all of a song brief, buy a song, request a revision, listen or download from a private portal, contact us, or interact with our advertising. If this Policy conflicts with our Terms of Service on a privacy issue, this Policy controls for that issue.
2. Information we collect
The exact information depends on how you use FondMelody. We collect information you provide, information generated through your order, technical information collected by the site, and limited information received from payment, analytics and advertising partners.
- Contact and order details: email address, purchaser name where supplied, recipient name, order reference, status and support history.
- Story and creative content: relationship, occasion, qualities, memories, dedication, preferred genre and voice, pronunciation guidance, revision requests, generated lyrics and finished audio.
- Payment and transaction data: amount, currency, tax, payment status and Stripe customer, checkout and payment identifiers. Stripe receives your full card and billing details; FondMelody does not store the full card number.
- Device and usage data: IP address, browser and device information, timestamps, pages and funnel steps viewed, button and checkout events, session identifiers, logs and error information.
- Advertising and attribution data: referral URLs, campaign parameters, advertising identifiers, product events, purchase value and, where used, a one-way hashed version of an email for conversion matching.
- Communications and feedback: emails, support requests, survey responses, reviews, testimonials and reaction media you choose to send.
A song story can reveal sensitive matters—for example health, religion, bereavement, family relationships or a child’s information. Please provide only details that are genuinely needed for the song and that you are authorised to share.
We collect information directly from you; automatically through cookies, local or session storage, pixels and server logs; from Stripe in connection with payment; and from advertising or referral partners when they direct you to FondMelody.
3. How and why we use information
We use personal information to:
- save your questionnaire progress and prepare your order;
- process payment, detect fraud and maintain transaction records;
- write, generate, review, store, deliver and revise your song;
- operate the private portal and verify access to an order;
- send confirmations, delivery notices and support responses;
- measure funnel performance, attribution and advertising results;
- test and improve site reliability, design and checkout flow;
- protect customers, enforce our Terms and investigate misuse; and
- meet tax, accounting, legal and regulatory obligations.
Where data-protection law requires a lawful basis, we rely on performance of a contract to accept and fulfil an order; legitimate interests to secure and improve the Service, provide support and understand business performance; legal obligations for records and valid legal requests; and consent for optional marketing or non-essential tracking where consent is required. You may withdraw consent at any time, without affecting processing that was lawful before withdrawal.
We do not make legal, employment, credit or similarly significant decisions about you using automated decision-making. Creative tools help produce and quality-check song material, with human review built into the fulfilment process.
4. Technology and service providers
The main technology services supporting FondMelody are listed below. They process information only as needed for their role and subject to their contracts and privacy terms.
VERCEL — website hosting and server functions. Vercel processes requests, device information, operational logs and the data needed to run the website.
STRIPE — checkout, payment processing, billing, tax and fraud prevention. Stripe receives payment and billing information and returns transaction details and payment status to us.
KIE — song and audio generation. Kie may receive the approved lyrics, title, story details, style and production instructions needed to create the song.
5. Cookies, analytics and advertising
FondMelody uses cookies and browser storage to keep the questionnaire and checkout working, remember first-touch attribution, maintain secure order or admin access, prevent duplicate conversion events and measure performance. Some storage is session-only; the funnel-lead identifier may remain for up to 30 days, and advertising measurement identifiers may remain longer according to the provider’s settings.
Analytics or advertising technologies can recognise a browser or device and record page, interaction, campaign and purchase events. Where applicable law requires consent before non-essential technologies are used, we will rely on consent. You can also delete or block cookies and local storage through your browser, although doing so may interrupt saved questionnaire progress, attribution or access features.
We do not sell personal information for money. Some privacy laws use broader definitions of “sale”, “sharing” or “targeted advertising” that may cover advertising pixels or attribution data. Where those rules apply, you may object or request an opt-out by contacting us.
6. When information is disclosed
We may disclose personal information:
- to the providers listed above so they can perform their services;
- to professional advisers, auditors, insurers or contractors under appropriate duties of confidentiality;
- when you ask us to share a song or connect with a third-party service;
- to comply with law, court orders or valid government requests;
- to investigate fraud, security threats or violations of our Terms;
- to protect the rights and safety of FondMelody, customers or others; or
- as part of a financing, merger, restructuring or sale of the business, subject to applicable safeguards.
We do not publish your private story, lyrics or song as a testimonial or advertisement without separate permission.
7. International transfers
Our providers operate across several countries, including the United States and countries where their infrastructure or staff are located. This means personal information may be processed outside your home country. Where required, we use contractual protections or another recognised transfer mechanism and assess whether additional safeguards are appropriate.
8. Retention
We keep personal information only for as long as reasonably needed for the purpose collected. Factors include whether an order or private portal is active, whether you may request revisions or re-delivery, support and dispute needs, fraud prevention, provider backup cycles, and tax, accounting or other legal obligations.
Funnel leads that never become orders may be retained for a shorter period than completed order records. Order, transaction and fulfilment records may be kept for several years where required for legal or accounting purposes. Audio, lyrics and story data may remain while we provide portal access and revision support. When information is no longer needed, we delete or anonymise it where reasonably possible. You may request deletion as described below, subject to lawful exceptions and provider backup cycles.
9. Security
We use measures designed to protect information, including restricted administrative access, signed private-portal tokens, encrypted HTTPS connections, private object storage and time-limited audio links, payment handling by Stripe, and separate production and staging credentials. No online service can guarantee absolute security.
Keep private order links confidential and contact us promptly if you believe someone has gained unauthorised access. Email itself may not be a secure place to send highly sensitive information.
10. Your privacy rights
Depending on where you live, you may have rights to ask for access to personal information, correction, deletion, restriction, portability, or an explanation of processing; to object to processing based on legitimate interests or used for direct marketing; to withdraw consent; and to appeal or complain to a data-protection regulator.
Email hello@mygiftmelody.com to make a request. Tell us the email and order reference connected with the request. We may need to verify your identity and authority before acting. Rights are not absolute: we may retain information needed for payment records, legal claims, security, another person’s rights or other lawful reasons. We will respond within the period required by applicable law.
You may opt out of promotional email using its unsubscribe link or by contacting us. We may still send necessary order, delivery, security and support messages.
11. Children and information about others
FondMelody is sold to adults and is not directed to children. We do not knowingly accept an order placed directly by a child. An adult may create a song about a child, but should provide only information reasonably needed for the song and must be the parent or guardian, have appropriate permission, or otherwise be legally authorised to provide it.
The same principle applies to information about any recipient or third party: you are responsible for respecting their privacy and obtaining permission where required. A parent or guardian who believes a child provided information directly may contact us to request review and deletion.
12. Changes to this Policy
We may update this Policy when the Service, providers or law changes. We will post the revised version here, change the date at the top and provide any additional notice required by law. Material changes apply from the stated effective date.
